Hiring of new Trump lawyer could signal battle with Mueller

  • Trump’s lawyer in Russia probe is retiring

The lawyer leading U.S. president Donald Trump's response to the special counsel investigation into Russian interference in the 2016 election is to resign.

Ty Cobb, the lawyer President Donald Trump brought in to lead the White House's response to the Justice Department's Russian Federation probe, is retiring.

That could come into play as Trump's legal team continues to negotiate a possible interview of the president by Mueller, whose team has said it could resort to a subpoena for Trump to appear before a grand jury.

He also spent two years in the White House Counsel's office for President George W. Bush's administration, where he was the lead lawyer handling hundreds of congressional investigations involving executive privilege- related issues, according to his online biography.

White House special counsel Ty Cobb will leave his role as a lawyer to President Donald Trump by the end of this month, according to the White House. The White House confirmed Flood's hiring after it was originally reported by the New York Times. His departure marks the latest in a string as the president shakes up his legal battalion. If it happens, that's not going to happen, I'll tell you that.

Two sources told CNN that Cobb was uncomfortable with Trump's tweets against Mueller, with one source describing a "rancid" atmosphere between Mueller and the White House. Legal experts told Business Insider last month that Mueller could be pushing for a voluntary interview because he does not believe he has the authority to indict the president, based on Department of Justice precedent.

On Tuesday, Fox News obtained a list of questions Mueller was slated to ask Trump, should they sit down for an interview.

Giuliani's account indicates that Cobb's exit is not simply a "retirement", as Sanders described it, but the result of a strategic dispute that Cobb lost to Sekulow.

Trump has since March adopted a more aggressive approach to the Mueller probe, lashing out in a series of tweets. He is close to White House Counsel Don McGahn and with McGahn's lawyer, Bill Burck, who also represents other key current and former White House staff. He ensured Mr. Trump along with the public that the Mueller evaluation would wind fast - first by Thanksgiving, then by the beginning of new year. Giuliani said Trump repaid Cohen, which contradicted earlier reporting on the matter.

The US president himself has said he is willing to speak to Mr Mueller, but US media report his enthusiasm has cooled after the offices of his personal attorney were raided.

But at least he'll be able to get a clearance, which ... is yet another problem for Trump's legal team in dealing with Mueller.

If Mueller's team decides to subpoena Trump, the president could still fight it in court or refuse to answer questions by invoking his Fifth Amendment protection from self-incrimination.
