Detectives in Florida were investigating whether the state's "Stand Your Ground" law applies after a man was fatally shot in front of his 5-year-old son at a convenience store, according to the Pinellas County Sheriff's Office.

While still on the ground, Drejka pulled out a gun and shot McGlockton in the chest, with a weapon he was legally carrying with a concealed carry permit.

Prior to Gualtieri's announcement Friday, Jacobs told the newspaper that McGlockton died from a "wrongful death" as a result of Drejka's actions.

Gualtieri announced Drejka had been cleared Friday.

"This will go to the state attorney".

"He wanted somebody to be angry at", Jacobs in reference to Drejka in an interview Monday with ABC.

Surveillance video provided to FOX 13 News by the store's owner, Ali Salous, shows the alleged altercation.

Richard Kelly, a regular at the convenience store, said he was confronted by Drejka once for parking his tanker truck in the same handicap spot.

Race has long played a prominent role in the perception of the controversial law, which has been on the books in Florida since 2005.

The video showed McGlockton wounded and stumbling back into the store, where he collapsed in front of his son. Jacobs was waiting for him in their auto with their two other children, a 4-month-old and a 3-year-old.

Britany Jacobs, the girlfriend of Markeis McGlockton, wants "justice" for the shooting of her boyfriend. Then, in an expansive 30-minute news conference, he tried to explain how the law connected to what was going through Drejka's mind when he pulled the trigger. "And he pushed him with great force".

Police, citing the "stand your ground" law, did not arrest Drejka. The vehicle was parked in a handicapped spot without a decal while McGlockton was in the store. "A witness goes in the store and he let the owner know that there was somebody out there messing with a woman in a auto", she said.

"It's a repeat. It happened to me the first time. The second time it's happening, someone's life got taken", Kelly said. He says prosecutors could still charge the shooter but Gualtieri's comments might make that hard. "What's relevant and the only thing we can look at here is was he in fear of further bodily harm".
