Are Democrats' Tactics to Delay Kavanaugh Nomination Actually Working?

Some Republicans had hoped the proceedings would begin in August - normally a vacation month for the Senate - but Democrats have slowed the process.

Republicans have been hesitant to request those records, however, and have accused Democrats of engaging in stalling tactics. Feinstein and Cory Booker (D-NJ), have already said they will not vote for Kavanaugh. Grassley did not request any additional documents pertaining to Kavanaugh's time as Bush's staff secretary. Chuck Grassley, R-Iowa, did not immediately respond to a request for comment. Taylor Foy, a spokesman for Grassley, said the senator still expects the hearing to take place in September.

That seems increasingly hard politically, as Democrats are demanding full access to the documents. What is clear, however, is that if Republicans do find a pretext for ramming Kavanaugh's confirmation through before the midterm elections, they would likely have to do so with incomplete information about his past.

The GOP statement said the committee was counting on receiving documents "in an even more rapid fashion" from the archives of the George W. Bush Presidential Library.

Standing before stacks of boxes that will be filled with documents from Kavanaugh's other jobs - an initial cache is expected later this week - Grassley and other top GOP senators argued there will be ample paperwork to review. The files don't include his 300 published opinions as a federal appellate court judge the past 12 years.

Grassley called it probably the "deepest dive" ever conducted on a Supreme Court nominee.

Some Democrats say they are concerned that Kavanaugh will not keep President Trump in check. "What more do they need to know to vote no?"

"I really want to thank the Democrats who have stood up for Judge Kavanaugh", Hatch told reporters at a press conference on Thursday. For The Washington Post, Robert O'Harrow and Michael Kranish look into Kavanaugh's role in independent counsel Kenneth Starr's investigation of the death of Clinton aide Vince Foster in 1993, reporting that "a memo offering legal justification for the probe" "sheds light on how Kavanaugh's thinking evolved on the legal rights of sitting presidents".

As Kavanaugh visits with senators on Capitol Hill - he has met with 47 senators so far, nearly all Republicans - questions about his approach to the special counsel law have been raised, senators said.

"Today, the National Archives confirmed our worst fear - that the vast majority of even the small portion of records the American public will see from Brett Kavanaugh's time in the Bush White House will be pre-screened by a political operative and attorney for George W. Bush, Steve Bannon, Reince Priebus, and Donald McGahn", the New York Democrat said.
