The homeless man from Philadelphia who gave a woman his last $20 last fall so she could fill up her gas tank is now suing her.

A New Jersey judge issued the order Thursday during a hearing on the lawsuit brought by Johnny Bobbitt, who worries Mark D'Amico and Katie McClure have mismanaged a large part of the donations raised for him on GoFundMe.

Mr Bobbitt alleges the couple sold his camper, gambled away some of the money donated to him, and have declined to provide financial records.

The lawsuit is seeking an undisclosed amount in damages, interest, and counsel fees, and for a "guardian ad litem" to be appointed for Bobbitt.

Bobbitt, a former Marine and first responder, spent his last $20 to help McClure buy gas after her auto broke down on the I-95 exit ramp near Philadelphia.

But the veteran soon accused the couple of withholding some of the more than $400,000 the campaign raised.

McClure and D'Amico raised almost $403,000 on GoFundMe starting late past year to buy Bobbitt, among other things, his own home and "dream" truck: a 1999 Ford Ranger.

While she acknowledged that it has not been proven at this time that McClure and D'Amico used the money for their personal benefit, Dow emphasized that Bobbitt is a "homeless individual without access to certain basic needs" and could suffer continued homelessness and lack of food if the money is disperated.

But the relationship has gone sour.

McClure and D'Amico have repeatedly denied any wrongdoing or misusing any of the money. Mr D'Amico has said Mr Bobbitt spent $34,000 in less than two weeks in December on drugs, in addition to paying overdue legal bills and sending money to his family.

With that money, they were able to buy Bobbitt a camper that he lived in outside of the couples' home.

Bobbitt's lawyer, Jacqueline Promislo, did not immediately respond to comment about the court filing, but previously told NBC News that they had planned to meet with D'Amico and McClure earlier this week to get a clear accounting of the funds.

In an interview with The Philadelphia Inquirer, McClure said she and D'Amico did what they could to help Bobbitt.

In court, lawyers argued about how much is left and where the money is now.

It is to be placed in an account controlled by Johnny Bobbitt's lawyers and frozen pending a new court ruling.

Bobbit also suspected that D'Amico, a carpenter, spent some of the donation money on gambling.

"He's really left us with no choice but to go forward", Fallon told Philly.com.

But D'Amico also insisted to the Inquirer that he won't give Bobbitt the money until he is sure the veteran is free of drugs, stating that he would rather "burn [the money] in front of him".
