"These documents suggest Judge Kavanaugh misled the Senate Judiciary Committee during his prior testimony", Booker said in a statement. In an op-ed for The New York Times, Linda Greenhouse "consider [s] the impact of Judge Kavanaugh's arrival on the eight other justices - on the dynamic of the Supreme Court as a whole", wondering what "the Supreme Court [will] look like when neither side has to walk on eggs to win the favor of the one in the middle". "Mr. Guttenberg has suffered an incalculable loss". If I'd known who he was, I would have shaken his hand, talked to him and expressed my sympathy.

Kavanagh's explanation was part of a 263-page response late Wednesday to some 1,287 written questions from senators.

Democrats have said they want to learn more about whether Kavanaugh played a significant role in controversial policy debates in the Bush White House, including those relating to the treatment of detainees held after the September 11, 2001, attacks. Democratic Sen. Cory Booker of New Jersey made the Bush documents public.

Blumenthal argued that there's an "even more urgent and pressing duty to get those documents and having witnesses to enable us to evaluate serious concerns raised as a result of evasive and seemingly misleading answers given to us at the hearing".

The White House prognosticated that the release of these questions was one more step in a successful confirmation process.

"I think they're playing a game to avoid the literal application of the bribery statute, " he said.

The Senate Judiciary Committee is delaying a vote on Supreme Court nominee Brett Kavanaugh until next week.

Democrats don't have the votes to block Kavanaugh's nomination, if Republicans hold unified, but are fighting it and decrying the process that Republicans used to compile his government records for review. Wednesday's disclosure brings the total to 75. "Booker appears to have violated provisions 5 and/or 6 of Rule 29 of the Standing Rules of the Senate (Rev. Jan. 24, 2013)", says the letter from Judicial Watch. But if Manchin voted against Kavanaugh, Morrissey would no doubt use that issue against him in attack ads.

Booker has welcomed the fight.

Democratic senators and others working to defeat Kavanaugh's confirmation believe Kavanaugh significantly misled the Judiciary Committee more than a decade ago on his involvement in controversial Bush-era programs and judicial confirmations. That can't happen. The organizers of the Kavanaugh opposition should denounce those tactics and make sure that the people they work with understand that threatening violence is a crime. Kavanaugh had indicated he was not substantially involved in the nomination.

The Supreme Court nominee was responding to questions from committee Democrats, who submitted them in writing for the record after his hearing concluded last Friday.
