  • James Comey Attorney Argues Closed Door Deposition Would Allow GOP to Take'Shots at This Guy in a Dark Alley

Former FBI Director James Comey moved Thursday to block a subpoena from the Republican-led House of Representatives, saying the closed-door interview demanded by lawmakers would be selectively leaked for political purposes.

Comey said he would like to testify publicly about the separate investigations into Hillary Clinton and Russian interference in the 2016 election - in front of live TV cameras as he has done before.

"In a letter dated October 1, 2018, Mr. Comey notified the Joint Committees that he would decline their invitation to sit for the proposed private interview but that he welcomed the opportunity to provide sworn testimony at a public hearing regarding the subject matters of the Joint Committees' Investigation".

"Try as he might, Mr. Comey may not condition his cooperation with a congressional investigation on the presence of television cameras", Hungar wrote. Kelly told the judge they sought to quash the subpoena because it violated House rules, "harasses the witness", and had no "legitimate goal", adding that it "wreaks of political theater".

In a Monday interview with CNN's Erin Burnett on "Erin Burnett OutFront", Goodlatte rejected Comey's proposition for a public hearing, calling a it "not an appropriate forum" because it could reveal investigative details to other potential witnesses.

Judge Trevor McFadden scheduled a 2 p.m. hearing on the motion for November 30. Comey is challenging a subpoena from House Republicans requiring him to testify privately on Monday, at the same time the judge is to announce his decision on the matter.

His attorneys argue the subpoena request violates House rules, which they assert operate under the presumption that hearings be open to the public.

James Comey's attorneys have raised a concern that Republicans had "abused their powers with selective leaks" of information to succeed their political agenda and further said, "by doing so, lawmakers had "unfairly prejudiced" prior witnesses". However, Comey is willing to make a testimony in public. "But I will resist a "closed door" thing because I've seen enough of their selective leaking and distortion".

They have also claimed the Federal Bureau of Investigation wrongly applied for a warrant to surveil former Trump campaign adviser Carter Page.

House Judiciary Committee Chairman Robert Goodlatte, who sent the subpoena, tweeted Thursday evening that Comey "believes he deserves special treatment, as he is the only witness refusing to either appear voluntarily or comply with a subpoena".
