Apple plans to resolve China iPhone ban with a software update

  • Apple to update iPhone software after threat of China ban

That victory was somewhat hollow, though, with the ban only affecting iPhones that ran older versions of iOS and in reality, nothing changed.

Although Qualcomm said that the injunction against Apple "would prohibit the import and sale of nearly all iPhone models in China", that has been the case at the moment.

Meanwhile, Qualcomm is pushing even harder on Apple, apparently emblazoned by the preliminary injunctions win this week.

Apple did not immediately respond to questions about the reconsideration request and Reuters was not independently able to confirm its authenticity. The initial injunction was based on Qualcomm's claim that Apple has infringed upon two patents dealing with software.

"Based on the iPhone models we offer today in China, we believe we are in compliance", Apple said.

The iPhone maker has appealed the decision. And it will come at a time when demand for Apple's most important product is slowing.

Apple is arguing that a settlement with Qualcomm could be detrimental to China's mobile industry. "It's all a game of high-stakes poker and Apple is going to fight this Qualcomm case with an iron fist", said Daniel Ives, an analyst at Wedbush.

Tax losses would also be caused to the government, Apple says, as it pays millions in feeds for the devices it sells in the country.

Just recently, Qualcomm was successful in its attempts to ban sales of several iPhone models in China. Qualcomm has not provided us with details of the specific patents Apple has infringed, but software patents often cover broad, vaguely worded concepts, leaving it open to interpretation which software might infringe them.

"Apple and many other companies, consumers, and government will suffer truly irreparable harm", the company said in the filing.

"This is what Qualcomm needed to get some leverage to try to get Apple to finalize a deal", said Mike Walkley at Canaccord Genuity LLC. On Thursday, Qualcomm confirmed that it has called on the court to enforce the rulings.
